Privacy Policy

This Privacy Policy explains how BimmerByte (“we”, “us”, “our”) collects, uses, shares, and protects your personal information when you visit bimmerbyte.co.za (the “Site”) or use our BMW coding, retrofit, and diagnostic services (the “Services”).

We process personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA) and the Electronic Communications and Transactions Act, 25 of 2002 (ECTA).

1. Who we are (Responsible Party)

For the purpose of POPIA, the Responsible Party is:

2. Information we collect

We collect the following categories of personal information:

  • Contact details you submit through the booking form — name, email address, and phone number.
  • Vehicle details — BMW model, year, and optionally the VIN (Vehicle Identification Number). We use the VIN solely to confirm which coding options your specific vehicle supports.
  • Service notes — any free-text description of the features you would like coded.
  • Technical information — when we perform coding on your vehicle, our diagnostic tools temporarily read your vehicle’s VIN, software versions, fault codes, and module configuration. This information is processed locally and is not transmitted to us outside the active coding session unless required to confirm compatibility with a manufacturer or third-party tool provider.

We do not knowingly collect personal information from children under 18. We do not collect special personal information (such as race, health, or biometric data).

3. Why we collect it (purpose)

  • To respond to your booking request and provide a quote.
  • To confirm which coding options are available for your specific VIN.
  • To arrange and perform the agreed Services at a time and place.
  • To invoice you and keep records required by SARS.
  • To contact you about your specific job, including follow-up, warranty support, or revisiting coding that has been reset by a dealer software update.
  • To comply with our legal obligations and to defend or pursue legal claims if necessary.

We do not use your information for marketing without your separate, explicit consent.

4. Lawful basis for processing

We rely on the following lawful bases in section 11 of POPIA:

  • Your consent, given when you submit the booking form and tick the consent box.
  • Performance of a contract with you — we cannot deliver the Services without this information.
  • Compliance with law, such as keeping invoicing records.
  • Our legitimate interest in running and protecting our business, where this is not overridden by your rights.

5. Who we share it with (Operators)

We share the minimum personal information necessary with the following third parties, each acting as an Operator under POPIA:

  • Web3Forms — processes our booking form submissions and forwards them to our email inbox. Their privacy policy is at web3forms.com/privacy. Hosted outside South Africa.
  • Vercel Inc. — hosts this website and may briefly log technical request information (IP address, user agent) for security and performance. Their privacy policy is at vercel.com/legal/privacy-policy. Hosted outside South Africa.
  • Email provider (Google / Gmail) — receives and stores your booking enquiry in our business inbox.

Where any of these Operators process your information outside South Africa, we rely on section 72 of POPIA — these providers are bound by laws or binding agreements that uphold principles substantially similar to POPIA, or processing is necessary for the performance of our contract with you.

We do not sell your personal information to any third party, ever.

6. How long we keep it

  • Unanswered enquiries: up to 12 months, then deleted.
  • Records of completed jobs (including VIN, model, codings performed): up to 5 years, so we can support warranty or revisit requests. After this period the records are anonymised or deleted.
  • Invoicing and tax records: 5 years as required by the Tax Administration Act.

7. Your rights under POPIA

You have the right to:

  • Be told what personal information of yours we hold;
  • Request a copy of it;
  • Ask us to correct or delete it;
  • Object to processing on reasonable grounds;
  • Withdraw your consent (where consent is the basis);
  • Lodge a complaint with the Information Regulator of South Africa at inforegulator.org.za.

8. Cookies and tracking

This website does not set any tracking cookies, advertising pixels, or analytics tags at this time. Strictly necessary cookies (e.g. to remember whether you have accepted this policy) may be set in future; if so, this section will be updated and we will ask for your consent where required.

9. Security

The Site is served over HTTPS with TLS encryption. We store your contact information in our email inbox, which is protected by multi-factor authentication. Vehicle coding sessions are conducted on isolated equipment that is not connected to the public internet during the coding operation. Despite our reasonable measures, no method of transmission or storage is 100% secure.

If we become aware of a security compromise that affects your personal information, we will notify you and the Information Regulator as required by section 22 of POPIA.

10. Changes to this policy

We may update this Privacy Policy from time to time. Material changes will be highlighted on the Site. The “Effective” date at the top of this page reflects when the current version took effect.
